CITY OF ROHNERT PARK CONCURRENT MEETING MINUTES FOR: City Council Community Development Commission Rohnert Park Financing Authority February 28, 2006 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community Development Commission and the Rohnert Park Financing Authority met this date in Regular Session for a meeting, commencing with a Work Session at 5:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Smith presiding. WORK SESSION: Call to Order: Mayor Smith called the Work Session to order at 5:03 p.m. Roll Call: Breeze, Flores, Vidak-Martinez, Smith Absent: Mackenzie (representing the Water Agency at a meeting in Washington, D.C.) Staff present for all or part of the meeting: City Manager Donley, Assistant City Attorney Whelan, Assistant City Manager Schwarz, Director of Community Development Bendorff, Director of Administrative Services Lipitz, Finance Services Manager Lauchner and Videographer Beltz. Economic Development: City Manager Donley reviewed the introduction to the Staff Report. Per the “Supporting Materials” portion of the Staff Report, Assistant City Manager Schwarz reported on the Specific Plan Annexation Process and Property Tax Review, and he responded to Council questions and comments. City Manager Donley reported on the City of Rohnert Park Business Attraction/Expansion Project., and he responded to Council questions and comments. City Manager Donley then reviewed the five Strategy Elements and responded to Council questions and comments. Director of Community Development Bendorff reported on Sonoma County Transportation Authority (SCTA) funding for the City Center Project. Council expressed agreement with Vice Mayor Vidak-Martinez’ suggestion that staff focus on marketing the Green Music Center. Six-Month Financial Review: Council agreed to DEFER the Six-Month Financial Review until such time as the full Council is present for said discussion. Mayor Smith adjourned the Work Session at 6:06 p.m. CITY COUNCIL MEETING: Call to Order: Mayor Smith called the meeting to order at 6:06 p.m. Roll Call: Breeze, Flores, Vidak-Martinez, Smith City of Rohnert Park CONCURRENT MEETINGS Minutes (2) February 28, 2006 for City Council/Community Development Commission/Rohnert Park Financing Authority Absent: Mackenzie (representing the Water Agency at a meeting in Washington, D.C.) Staff present for all or part of the meeting: City Manager Donley, Assistant City Attorney Whelan, Assistant City Manager Schwarz, Director of Community Development Bendorff, Director of Administrative Services Lipitz, Finance Services Manager Lauchner, Housing and Redevelopment Project Manager Ellena, Director Public Safety Bullard, Public Safety Sergeant Sweeney and Videographer Beltz. ADJOURN TO CLOSED SESSION TO CONSIDER: Mayor Smith adjourned Council to Closed Session at 6:06 p.m. to consider Real Property Negotiator Matters. REGULAR SESSION: Mayor Smith reconvened Regular Session at 6:30 p.m. MOMENT OF SILENCE: At the request of Mayor Smith, Council and the audience observed a moment of silence for Silvio “Sil” C. Cincera, a longtime community leader. 1. PLEDGE OF ALLEGIANCE: Jesse Yen, Student, Waldo Rohnert Elementary School, led the Pledge of Allegiance. Mayor Smith thanked Jesse and PRESENTED him with a card. 2. MAYOR’S REPORT ON CLOSED SESSION: Mayor Smith stated that there are no reportable items from Closed Session. He also commented on the Work Session as noted above. 3. SCHEDULED APPEARANCES/PRESENTATIONS: None. 4. SSU STUDENT REPORT: Sonoma State University Associated Students, Inc. by James J. Reilly, III, Legislative Representative: Mr. Reilly was not present. 5. UNSCHEDULED PUBLIC APPEARANCES/COMMENTS: Mayor Smith called forward members of the public who submitted speaker cards. 1. Ian Sutherland, 2Varda Street, was recognized and, as a member of Save the Grove, he called for the City to take action on the Nexus Plan it discussed at the Special Meeting of January 31, 2006. He discussed ongoing threats from the new park manager, and he expressed a desire to hear from the Planning Commission soon. City of Rohnert Park CONCURRENT MEETINGS Minutes (3) February 28, 2006 for City Council/Community Development Commission/Rohnert Park Financing Authority 2. Penny Hamilton, 42 Anne Street, was recognized and shared her explanation with the Council as to why the members of the Grove did not accept the City’s money, noting that the new terms of tenancy are unacceptable to those fighting to preserve the Sonoma Grove community. She discussed ongoing problems with the bathhouses, and she expressed concern with the new owner’s transient RV policy. 3. Frank Willis, 62 Varda, was recognized and urged Council to maintain Sonoma Grove as a permanent trailer park for very low income individuals. He asked Council if residents can be forced to move if they’ve established residency. Assistant City Attorney Whelan commented on Civil Code sections regarding residency, as well as the Santa Cruz case. 4. Alice McAdams, Sonoma Grove, was recognized and commented to Council how the City has lost the opportunity to have Sonoma Grove considered Open Space. 6. C O N S E N T C A L E N D A R: Mayor Smith asked if there were any questions about matters on the Consent Calendar. The following items were removed: Resolution 2006-64 per Councilmember Flores’ recommendation. A. Approval of City Council Portion of Concurrent Meeting Minutes for: Special Concurrent City Meetings – January 31, 2006 Regular Concurrent City Meetings – February 14, 2006 B. Approval of Bills/Demands for Payment concurrently for: City of Rohnert Park/City Council in the amount of $1,706,356.22 C. Accepting Cash/Investments Report for Month Ending January 31, 2006: City of Rohnert Park/City Council (DEFERRED) D. Resolutions for Adoption: 2006-58 Rejecting the Claim of John & Cheryl Mackey for alleged damage to residence from flood 2006-59 Rejecting the Claim of Melissa Cummings for alleged damage to automobile from flood 2006-60 Approving Amendment No. 3 to Task Order 2004-10 with Winzler & Kelly Consulting Engineers for Professional Services associated with the Preparation of a City-wide Water Supply Assessment 2006-61 Authorizing and Approving Task Order 2006-03 with Winzler & Kelly Consulting Engineers for Design Services for the Manhole Retrofit Inflow and Infiltration Reduction Project No. 2004-10 2006-62 Approving the Agreement with Alves & Associates for Services for Emergency Management Consulting Services 2006-63 Calling for Sealed Proposals for Exercise Equipment for the Sports Center City of Rohnert Park CONCURRENT MEETINGS Minutes (4) February 28, 2006 for City Council/Community Development Commission/Rohnert Park Financing Authority 2006-65 Honoring George A. Clair of North Bay Towing for his Assistance during the Flood E. Approving Project Graduation Request for Waiver of Fees for use of the Sports Center for June 9, 2006 Annual Event Upon MOTION by Vice Mayor Vidak-Martinez, seconded by Councilmember Flores, and APPROVED 4-0-1 with Councilmember Mackenzie absent, reading was waived and the Consent Calendar, with the exception of Resolution No. 2006-64, was ADOPTED. Item for Consideration: 2006-64 In Remembrance of Silvio “Sil” C. Cincera At the request of Mayor Smith, Councilmember Flores read the resolution commemorating the life of Silvio “Sil” C. Cincera. Upon MOTION by Councilmember Flores, seconded by Vice Mayor Vidak-Martinez, and APPROVED 4-0-1 with Councilmember Mackenzie absent, reading was waived and Resolution 2006-64 was ADOPTED. 7. DEPARTMENT OF PUBLIC SAFETY REPORT: 911 Cellular Telephones and Graffiti Report: Director of Public Safety Bullard gave an oral report on said topics, and he responded to Council questions and comments. Mayor Smith recommended that all residents put the Department of Public Safety’s number, 584-2611, in their cell phones. Councilmember Flores suggested that staff again put this information in the “City Pages” of The Community Voice. Review of Impact on Police Services by Thunder Valley Casino: Department of Public Safety Sergeant Sweeney reviewed the Staff Report and responded to Council questions and comments. City Manager Donley indicated that said report will be posted on the City’s web site. 2005 Crime Statistics: Department of Public Safety Sergeant Sweeney DISTRIBUTED AND REVIEWED a handout regarding the Special Enforcement Unit’s (SEU) Long-Term Crime Reduction Goals. Said packet also included the complete set of statistics from Placer County regarding Thunder Valley Casino. Sergeant Sweeney responded to Council questions and comments. Vice Mayor Vidak-Martinez suggested that staff make the 2005 Crime Statistics available to the public in The Community Voice. Mayor Smith REQUESTED (1) a fireworks report at the first Council meeting in July, and (2) a report on the use and effectiveness of tasers at the next Public Safety update to Council. Vice Mayor Vidak-Martinez REQUESTED an update regarding Emergency Operations with notification to Council as to when it will happen. 8. PLANNING AND ZONING MATTERS: Review of Planning File PL2005-069TM – Tentative Map to allow the subdivision of a lot into 8 live/work spaces at 5210 Country Club Drive, east side of Country Club Drive, south of Golf Course Drive: City of Rohnert Park CONCURRENT MEETINGS Minutes (5) February 28, 2006 for City Council/Community Development Commission/Rohnert Park Financing Authority 1. Staff Report: Senior Planner Bendorff reviewed the contents of the Staff Report and responded to Council questions and comments. Council discussed Councilmember Breeze’s suggestion that there be some type of disclosure that the live/work units are located next to a fire station. 2. PUBLIC HEARING: Mayor Smith opened the Public Hearing at 8:28 p.m. There being no members of the public interested in speaking on this matter, Mayor Smith closed the Public Hearing at 8:28 p.m. 1. Resolution for Adoption: 2006-66 Approving a Tentative Map to Allow the Subdivision of a Lot into 8 Live/Work Spaces on Property Located at 5210 Country Club Drive (APN 143-311-056) Siamok Taromi Council motion/discussion/vote: Prior to the motion, at the request of Mayor Smith, Assistant City Attorney Whelan indicated that, with Council concurrence, language to the effect of the following shall be added to the resolution: The applicant shall be required to include on a Department of Real Estate disclosure form that said project is located next to a fire station. A MOTION was made by Vice Mayor Vidak-Martinez, seconded by Councilmember Flores, to adopt Resolution 2006-66 with the above-noted amended language. Under discussion, Mayor Smith inquired of the applicant, Siamok Taromi, if this amended language would be a problem, to which the applicant indicated that it would not be a problem. After the motion, which was APPROVED 4-0-1 with Councilmember Mackenzie absent, reading was waived and Resolution 2006-66 was ADOPTED AS AMENDED per staff’s recommended wording. 9. COMMISSION/COMMITTEE/BOARD APPOINTMENTS: 1. Council action regarding nominations and appointments for two two-year terms expired December 31, 2005: Mobile Home Parks Rent Appeals Board to fill vacancy: Sister Cities Relations Committee to fill vacancy: Mayor Smith encouraged interested members of the public to submit applications for these appointments. 10. COUNCIL COMMITTEE AND/OR OTHER REPORTS: 1. Sonoma County Waste Management Agency 2/15/06: Mayor Smith reported on tip fees. 2. Garbage Sub-Committee meeting 2/15/06: Councilmember Breeze and Mayor Smith reported on several topics of discussion, including the state of the landfill and the state of the North Bay Disposal facility. 3. Water Issues Sub-Committee meeting 2/15/06: Councilmember Flores commented on the flooding this past December and January. At the request of Councilmember City of Rohnert Park CONCURRENT MEETINGS Minutes (6) February 28, 2006 for City Council/Community Development Commission/Rohnert Park Financing Authority Flores, Council CONCURRED TO DIRECT STAFF to form a citywide subcommittee to consist of Director Public Works Jenkins, Management Analyst Tacata, Councilmembers Flores and Mackenzie, a Parks & Recreation Commission member and a Planning Commission member, to consider the comprehensive development of a Creek Master Plan. 4. Santa Rosa Plain Conservation Strategy Implementation Committee 2/15/06: CityManager Donley reported on this matter per a phone call from Councilmember Mackenzie who attended the committee meeting. City Manager Donley reported on matters, including the Interim Guidance letter, which will be before Council at their March 14th meeting. 5. FEMA Meeting 2/16/06: Mayor Smith noted his attendance at said meeting, and he reminded members of the public who incurred losses due to the recent flooding that all paperwork regarding such losses must be turned in by Friday, March 3rd. He encouraged citizens to contact FEMA at 1-800-621-3362. 6. First CA Citizen Congressional Hearing on Health Care with Congresswoman Lynn Woolsey 2/18/06: Mayor Smith noted a discussion on Universal Health Insurance. 7. Dennis Dorch Retirement Dinner 2/19/06: Mayor Smith noted his attendance at said event. 8. So. Co. Waste Management Agency (SCWMA) e-waste Disposal 2/21/06: Mayor Smith noted a discussion on e-waste and a possible rate increase. 9. Russian River Watershed Association 2/23/06: Councilmember Mackenzie was not present to report on said meeting. 10. Business Environmental Alliance 2006 Environmental Forecast 2/24/06: Mayor Smith noted his attendance at said meeting. 11. Other informational reports, if any: None. 11. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Councilmembers. The following communications were pulled for further discussion: 1. Letter regarding Transient Occupancy Tax (TOT): Mayor Smith called attention to said letter and indicated that the City expects to be reimbursed its TOT revenues in a timely manner. 12. MATTERS FROM/FOR COUNCIL: 1. Appointment of a City-School District Ad-Hoc Committee: At the suggestion of Mayor Smith, Council CONCURRED to direct the Mayor to appoint a City-School District Ad Hoc Committee to work on negotiations regarding the Goldridge Elementary School property. Mayor Smith APPOINTED Councilmembers Mackenzie and Breeze to said ad hoc City of Rohnert Park CONCURRENT MEETINGS Minutes (7) February 28, 2006 for City Council/Community Development Commission/Rohnert Park Financing Authority committee, and Assistant City Attorney Whelan commented on the ad hoc committee’s status. 2. Consideration of a Joint Planning Commission / City Council Meeting: At the suggestion of Mayor Smith, Council CONCURRED TO DIRECT STAFF to arrange for said joint meeting. Mayor Smith also noted his interest in having the Parks & Recreation Commission have a joint meeting with the PROS Committee sometime in the future. 3. Schedule of Events and Meetings: Document provided to Council in the agenda packet. 4. City Council Agenda Forecast: Document provided to Council in the agenda packet. 5. Other informational items, if any: None. 13. CITY MANAGER’S REPORT: 1. Sign Ordinance Update: Assistant City Manager Schwarz explained the contents of the Staff Report. Vice Mayor Vidak-Martinez REQUESTED (1) that a signage problem on Redwood Drive be cleared up, and (2) that staff look at profuse signage regarding alcohol, particularly near a school or public building. Furthermore, she expressed an interest in consistency throughout the City. 2. Legislative Update: Assistant City Manager Schwarz reported on Redevelopment Reform, Community Development Block Grant Funding and Proposition 42, noting that a letter regarding Proposition 42 will come before Council for consideration at their next meeting on March 14th. Council discussion/direction: Mayor Smith suggested that Council and staff track Assembly Bill 2491 regarding local control of speed limits. 3. FEMA Flood Assistance: City Manager Donley stated that said matter had been sufficiently covered previously in the Council meeting. 4. Informational items, if any: a. Invitiation to Tanglewood: City Manager Donley indicated that Sonoma State University has inquired about Council interest in going to Tanglewood, Massachusetts on August 3-6 to see how their music center works. Councilmembers expressed an interest in learning more about the trip, and City Manager Donley requested that Council get back to him on this matter. b. League of California Cities briefing on the Governor’s Strategic Plan: City Manager Donley inquired about Council interest in attending said meeting this Friday at San Francisco’s Ferry Building. Mayor Smith indicated that he may be able to attend. 14. PUBLIC COMMENTS: Mayor Smith invited members of the public interested in speaking to come forward.
